Abstract

The concept of waqf is not related exclusively to build mosques and traditional schools, but it can emerge in other forms,
including fields of education as well scientific researches. It is possible to effectively realize and develop waqf properties for academic purposes, within the framework of an Islamic economic system that is based on the concept of realizing the Maqasids of Chariah instead of maximizing profit. However, there is a lack and a deep confusion about the benefits of waqf as a pillar for education development. At present, Morocco has Al Quaraouiyine University funded based on waqf, but 12 public universities without a global vision. Based on the practice of waqf in other countries, a literature review is conducted to provide an adequate reinterpretation. Our results indicate that, there is a need for further theoretical and practical development of waqf in the areas of education, health and scientific research. The paper, it will be suggested to propose a standard law on waqf and to formulate a new legal framework for waqf of higher education institutions taking into account all the issues identified in the study.
